General Terms and Conditions (AGB)

1. Scope of application

• These General Terms and Conditions (GTC) govern the rights and obligations of Hostettler-Spezialzucker AG and its customers. They form an integral part of all contracts concluded between the customer and Hostettler-Spezialzucker AG.

2. Orders

• An order must be received by Hostettler-Spezialzucker AG at least 2 working days before the desired delivery.
• Unless otherwise agreed, Hostettler-Spezialzucker AG expressly reserves the right to adjust quantities or prices as a result of force majeure, shortages of raw materials, market changes and price changes imposed by the authorities.

3. Delivery

• The Incoterms 2010 shall apply
• If the weight of an order is less than 30 kg, the goods can be delivered by post.
• Risk and ownership of the delivered goods shall pass to the customer after collection or delivery.

4. Returnable containers

• Returnable IBCs or plastic pallets are the property of Hostettler-Spezialzucker AG.
• Returnable containers must be returned to Hostettler-Spezialzucker AG promptly, usually with the next delivery.

5. Terms of payment

• Unless otherwise agreed, invoices shall be due for payment within 30 days of the delivery date.

6. Complaints

• Complaints about the delivery or invoice must be made immediately, but no later than 5 days after receipt of the delivery or invoice.

7. Changes to the GTC

• Prices and GTC are subject to change at any time.

8. Place of jurisdiction and applicable law

• All disputes shall be settled by the ordinary courts at the registered office of Hostettler-Spezialzucker AG.
• Swiss law shall apply exclusively.
